Verification of your Identity
In recent years, several properties (WA & NSW) were sold fraudulently, and under The Real Property Act (1886), the True owners were only entitled to receive monetary compensation for their loss.
Two mechanisms allowed this to happen;
Firstly, under the Real Property Act (1886), being in possession of the Certificate of Title was sufficient to prove ownership of the property, and
Secondly, there were no obligations placed on Agents or Conveyancers to formally identify their clients or confirm they were indeed the Legal owner!
As a result the Conveyancing process is undergoing an enormous change!
Due to be released this year, Conveyancing will become an electronic process, and “paper” Certificates of Title will eventually be abolished. In preparation for this move, since June 2013 all SA Conveyancer’s have been required to identify their client’s in person, whether they are Selling or Purchasing.
